Read a German employment offer in three passes

A practical method for separating role facts, employment mechanics and clauses that need specialist legal attention.

Reading every clause with equal anxiety makes it hard to see the offer as a whole. A three-pass review creates useful questions without pretending that a checklist can determine legal enforceability.

Pass one: describe the job

Mark the employer entity, title, duties, reporting line, location, start date and whether the agreement is fixed-term. Compare these with what was said during interviews. Ambiguity about travel or remote work belongs in a question before signature.

Pass two: trace time and money

Write down gross salary, payment timing, stated working hours, overtime treatment, annual leave, bonus conditions and benefits. Then map Probezeit and notice periods on a calendar. Look for references to a collective agreement or policies outside the document.

Pass three: identify restrictions

Highlight confidentiality, intellectual property, secondary work, repayment, mobility and post-employment provisions. Ask what behaviour each clause is intended to govern. If you need to know whether a restriction is valid or how a court would apply it, consult a German employment lawyer.

Finish with two lists: practical questions for HR and legal questions for counsel. Keeping them separate helps each professional give you the right kind of answer.
